While the memo is a policy proposal drafted by Mr. Romney’s advisers in September 2011 — not a final decision by him — its detailed analysis dovetails with his rare and limited public comments about interrogation.

Rand Paul (R-KY) made headlines last week for single-handedly obstructing the renewal of the Patriot Act, calling the law an unconstitutional infringement on civil liberties. His demand to insert a series of amendments to weaken the law nearly allowed it to lapse and put the country at “risk,” but Paul said it was worth it to prevent the government from continuing to “blatantly ignor[e] the Constitution.” But when Paul went on Fox News host Sean Hannity’s radio show Friday to discuss his opposition to the national security law, he suggested implementing a far more serious infringement on civil liberties.

Congressis set to reauthorize three controversial provisions of the surveillance law as early as Thursday. But Wyden says that what Congress will renew is a mere fig leaf for a far broader legal interpretation of the Patriot Act that the government keeps to itself — entirely in secret. Worse, there are hints that the government uses this secret interpretation to gather what one Patriot-watcher calls a “dragnet” for massive amounts of information on private citizens; the government portrays its data-collection efforts much differently.

In Holder v. Humanitarian Law Project, the court ruled that the USA Patriot Act's expanded definition of “material support” for “foreign terrorist organizations” passes Constitutional muster. The broad wording of the statute not only makes it a crime to support violent activities, but also prohibits Americans from offering "services" or "training, expert advice or assistance" to any entity designated as a terrorist group.

The study, titled "Reclaiming Patriotism," identifies key sections of the law that codified the most radical abuses of power under the Bush administration, interweaving stories of people who were unlawfully spied on, coerced, and intimidated through the PATRIOT Act's sweeping powers. "More than seven years after its implementation, there is little evidence to demonstrate that the Patriot Act has made America more secure from terrorists," the report's authors write. "But there are many unfortunate examples that the government abused these authorities in ways that both violated the rights of innocent people and squandered precious security resources."
